Get Ahead Real Estate

Terms of Service

Website and property services

1. Business and application

These Terms of Service apply to getaheadrealty.com.au and its associated entities and to enquiries, resources and services expressly supplied on these terms by Get Ahead Real Estate Pty Ltd. You means the person using the relevant service or accepting these terms. The website describes property research, sourcing, introductions and buyer-related services. The specific role we perform in a transaction depends on our written appointment and disclosures.

2. Acceptance and document priority

These terms are made available before any service or form requiring acceptance. You agree to them when you expressly accept them through a clearly labelled form or written engagement. Simply browsing does not create a paid engagement or appoint us as your agent. Restrictions on use of our intellectual property apply independently under law. A separate signed agency or service agreement is required where applicable and sets out our role, scope, fees, authority, duration and cancellation terms. Mandatory law prevails. Subject to mandatory law, that specific signed agreement prevails over these general terms in any inconsistency; it does not retrospectively remove rights accrued under these terms. A sale contract, building contract, loan or professional-adviser engagement is separate.

3. Our role and authority

We act only within the services and authority agreed in writing and the licences and authorisations applicable to the relevant jurisdiction. A free call, property introduction or access to a report does not itself establish our appointment, fiduciary relationship or authority to bind you. If we are formally appointed as your agent, applicable statutory, fiduciary and professional obligations apply and are not excluded by these terms. We cannot sign a purchase contract, waive a condition, incur an expense or commit funds on your behalf without valid authority. Where we act for a vendor or developer, or as an introducer rather than your buying agent, we disclose that role before you rely on the service.

4. Advice boundaries

Website content, reports, market commentary, webinars, calculators and free strategy discussions provide property information within their stated scope. Unless separately agreed with an appropriately authorised professional, we do not provide financial product advice, credit assistance, tax advice, legal advice, formal valuations, building certification or engineering advice. Property sourcing does not establish that a purchase is suitable for your personal finances. Obtain advice from independently selected and appropriately licensed or qualified advisers before relying on tax, borrowing, legal, superannuation or structural assumptions. These boundaries do not excuse a failure to perform a service we have actually agreed to provide with legally required care and skill.

5. SMSFs and superannuation

We may source or introduce residential or commercial properties for an existing SMSF on an authorised property brief. We do not recommend establishing an SMSF, rolling over superannuation, choosing an SMSF over another fund, or a particular financial product or borrowing arrangement unless lawfully authorised under a separate engagement. Describing a property as “SMSF-ready”, “SMSF suitable” or similar does not certify that a particular fund can lawfully buy, lease, borrow against or improve it. Before committing, obtain independent licensed financial advice and legal and tax advice on the fund’s investment strategy, sole purpose test, related-party restrictions, business real property rules, liquidity, diversification, LRBA and holding-trust structure, timing, tax and audit requirements. Do not rely on a property introduction to satisfy these requirements.

6. Property information and due diligence

Property particulars may include information from vendors, developers, agents, public records and data providers. We use reasonable care within our agreed service but some information is indicative, dated or subject to verification. Confirm price, availability, title, tenure, boundaries, areas, plans, approvals, restrictions, easements, outgoings, GST, tenancy terms, rental evidence, insurance availability, environmental hazards and material defects before committing. Request appropriate legal, building, pest, strata, planning and other specialist checks. A neighbourhood visit, visual inspection or street walk does not substitute for these checks. We explain the scope and limitations of inspections we undertake. You are responsible for decisions outside our agreed role; we remain responsible for our own obligations and representations.

7. Forecasts, yields and valuation comparisons

Growth forecasts, rental appraisals, yields, vacancy figures, cashflow models, equity estimates and “below market” or “below bank valuation” comparisons must be read with their stated source, date, assumptions and qualifications. They are not promises of future performance. Gross yield excludes expenses unless expressly stated; net outcomes depend on vacancy, maintenance, management, insurance, rates, taxes, finance costs and other expenses. Past performance does not reliably predict future returns. Valuations and comparable sales vary with purpose, date and assumptions; a valuation gap does not guarantee usable or instant equity, resale profit or lending approval. Prices and rents can fall, vacancy can rise and you can lose capital. Nothing here qualifies away a specific factual representation that must be accurate and supported when made.

8. Calculators, readiness checks and examples

Calculator outputs and readiness scores are illustrative estimates based on limited inputs and model assumptions. They are not finance pre-approval, an investment suitability assessment, a personalised financial plan or a forecast you should rely on to commit funds. Portfolio asset value differs from net wealth and usable equity; borrowing and acquisition costs must be considered. Tax and depreciation estimates require qualified advice. Any bank-deposit comparison must account for differing risk, liquidity, leverage, fees and tax treatment. Check the disclosed assumptions, including growth, yield, interest rates, expenses, deposit requirements and borrowing capacity. Client stories describe individual experiences only and do not establish typical results or guaranteed outcomes.

9. Fees, commissions and conflicts

We disclose the transaction role, remuneration arrangements and material conflicts before the relevant commitment and in the required written documents. For the vendor-paid service advertised on our website, we do not charge you an upfront or buyer-service fee; the vendor or developer pays our agreed remuneration at settlement. This does not mean a purchase is cost-free: deposit, duty, legal fees, finance, inspection, holding and other transaction costs may apply. Any different buyer-paid service requires your prior written agreement stating the fee, GST treatment, payment trigger and scope. Vendor-paid remuneration creates a potential conflict and may limit the properties we introduce; do not assume our shortlist covers the whole market. We disclose commissions, referral benefits and relevant relationships to the extent required by law and agreement, including amounts or calculation methods where required. We do not represent that vendor-funded sourcing is independent buyer representation unless the actual appointment and applicable law support that representation.

10. Enquiries, bookings and referrals

Free strategy calls are without obligation and do not require a purchase or create a payment obligation. A form confirmation acknowledges receipt or a booking request; a particular time is confirmed separately unless clearly stated otherwise. Please give accurate information, keep appointments or advise if you need to reschedule, and communicate respectfully. A referral does not oblige you to use the provider. Third-party advice and contracts are provided by that provider, subject to its terms, but we remain responsible for our own referral conduct and any duties we owe. We disclose material referral remuneration and obtain permission to share personal information where needed.

11. EOIs, deposits and property commitments

Submitting an enquiry or expression of interest does not itself secure a property or create a purchase contract unless a separate document lawfully provides otherwise. Before paying an EOI or reservation amount, obtain written confirmation of the recipient, authorised payment channel, purpose, whether it is held in trust, and the actual refund conditions and timing. We do not impose a blanket “non-refundable” rule through these website terms. Refund and cooling-off rights depend on applicable law and the specific lawful agreement. Property availability, price, construction scope and completion dates require transaction-specific confirmation. Verify payment instructions by calling a previously verified telephone number; never rely solely on an email changing bank details. This precaution does not transfer liability for our own security failures to you.

12. Your cooperation and lawful use

Give accurate and complete information material to the agreed service, tell us about relevant changes, and provide evidence of authority if acting for another person or entity. You must not submit fraudulent documents, impersonate another person, misuse others’ information, attack the website, bypass access controls, distribute malware or unlawfully copy our materials. If a material breach creates a real security or legal risk, we may restrict the affected website or service access proportionately, explain the reason where lawful, and provide an opportunity to resolve it where practicable. Restrictions do not remove statutory remedies, agreed cancellation rights or refunds for unprovided services where due.

13. Verification and legal compliance

We may require identity, beneficial-owner, source-of-funds and other information reasonably needed to comply with applicable laws. Where a service is regulated under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006, required checks must be completed before proceeding where the law requires. We may pause or decline a service if legally required or if required verification cannot be completed. We give notice and reasons where lawful; reporting confidentiality may prevent some explanations. Any fee or refund consequence must follow applicable law and the signed engagement, rather than an automatic forfeiture under these terms.

14. Intellectual property, confidentiality and privacy

We or our licensors own website content, original reports, branding and tools. You may use lawfully supplied materials for your own property evaluation, retaining attribution and notices. Republishing, selling, distributing commercially or extracting content at scale requires permission unless permitted by law. You retain ownership of information you supply; you give us only the rights reasonably necessary to process it for your enquiry or agreed service. You do not grant us a general right to publish your story, identity or documents. We obtain appropriate permission for testimonials and identifiable case studies. We protect confidential client information subject to authorised use and lawful disclosure. Our Privacy Policy explains information handling; acceptance of these terms is not blanket marketing or tracking consent.

15. Website availability and external providers

We take reasonable steps to maintain the website but interruptions may occur through maintenance, faults or events outside reasonable control. We may change website features prospectively; we do not change an existing paid scope or promise merely by editing the website. External links and embedded content are supplied by third parties. We do not control their content or ongoing availability, and a link is not a general endorsement. If an external failure affects an agreed service, we take reasonable steps to notify you and minimise disruption and comply with applicable remedies.

16. Consumer rights and liability

Nothing in these terms excludes, restricts or modifies consumer guarantees under the Australian Consumer Law, liability for misleading or deceptive conduct, mandatory agency duties, or any right or liability that cannot lawfully be excluded or limited. This includes applicable remedies for a failure to supply services with due care and skill. We do not exclude liability for our fraud, wilful misconduct or negligence causing personal injury, or use these terms to avoid mandatory privacy duties.

Subject to those protections, we are not liable for a market outcome merely because a property investment performs differently from an illustrative scenario, where that outcome was not caused by our breach of duty or misleading representation. To the extent permitted by law, neither party is liable to the other for loss that was not reasonably foreseeable when the relevant agreement was made. Reasonably foreseeable loss is not excluded merely because it is described as indirect, consequential or lost profit.

For services not of a kind ordinarily acquired for personal, domestic or household use or consumption, and only where section 64A of the Australian Consumer Law permits it and it is fair and reasonable, liability for a breach of a consumer guarantee is limited, at our option, to supplying the services again or paying the cost of having them supplied again. This limitation does not apply where unlawful or unfair, or where section 64A cannot apply. Any other negotiated liability limit must be contained in a separately reviewed engagement agreement.

17. Responsibility for deliberate misuse

If your fraud or intentional unlawful misuse of the website directly causes us reasonably incurred loss, we may seek recovery to the extent permitted by law. Any recovery is reduced to reflect our contribution and reasonable steps we could have taken to mitigate the loss. This clause does not require you to indemnify us for our negligence, misconduct, breach of contract or statutory duty, and does not impose automatic legal costs or liability for an innocent mistake. Costs of proceedings are determined by the applicable law, court or tribunal.

18. Ending services and resolving complaints

Service duration, termination notice, earned fees and cancellation consequences are set out in the signed engagement and applicable law. These general terms do not create an automatic cancellation penalty, waive a cooling-off right or prevent remedies for deficient services. Either party may raise a concern using the contact details below. We aim to acknowledge complaints within five working days and respond substantively within 30 calendar days, or explain any necessary extension. Both parties should try in good faith to resolve a dispute, but this does not prevent urgent relief, a regulator complaint or proceedings in a court or tribunal with jurisdiction, and does not suspend statutory deadlines.

19. Changes, governing law and general provisions

Updated terms apply prospectively to new acceptances. We do not vary an existing engagement, accrued rights or fee obligations simply by posting revised terms; material contractual changes require an agreed process consistent with law. Subject to mandatory laws applicable elsewhere, these terms are governed by New South Wales law and the parties submit to the non-exclusive jurisdiction of NSW courts and any tribunal with lawful jurisdiction. This does not prevent a consumer using another forum available under mandatory law. If a provision is invalid or unenforceable, it is severed to the extent possible and the remainder continues; severance does not authorise reliance on an unfair term. Failure to exercise a right promptly is not a waiver. Neither party may use these terms to override a specific written commitment or exclude reliance on an actionable representation.
